This Privacy Notice explains how Quantas Capital Limited (“Quantas”) collects, uses, stores, transfers, erases and destroys your Personal Data (as defined below) by your use of our website www.quantasinvest.com and the provision of services (“Services”) by us to you. In this Privacy Notice, any reference to “we”, “us” and “our” refers to Quantas and or its affiliates. This Privacy Notice applies to clients, prospective clients, employees, website users and service providersand where applicable their directors and officers.

“Personal Data” means any data (whether stored in an electronic or printed form) relating to a living individual who can be identified:
a. from the data; or
b. from the data and other information in the possession of Quantas.
Persons responsible for collecting and processing your personal data
Your Personal Data is collected and controlled by the employees of Quantas on the basis of the performance of a business relationship to which you are a party or for the taking of steps with a view to entering a business relationship with you for the provision of Services.
Types of personal data which may be collected
We may collect the following types of Personal Data:
a. Information which is needed for identifying you, such as your name, date of birth, home address, business address, telephone number, mobile number, tax identification number and email address.
b. Information on payment transactions and data which is necessary for us to process payments on your behalf but at the same time implement fraud prevention measures, including credit / debit card numbers, security code numbers and other such relevant billing details.
c. Technical information including internet protocol (IP) address, browser type and version, plug in types and versions, operating system and platform and other technology on the devices you use to access this website.
d. Information collected from publicly available resources or forums, including but not limited to information collected from databases we use to carry out compliance checks.
e. Other information relevant to the provision of the Services.
This is a non-exhaustive list which is reflective of the varied nature of the Personal Data processed.
How we collect your personal data
We will collect your Personal Data in the following circumstances:
a. When you request an estimate for our Services, engage our Services, request marketing to be sent to you and give us feedback.
b. When you make an enquiry in person, via email, instant messenger including but not limited to WhatsApp, over the telephone or any other medium which Quantas may be contacted.
c. When you are browsing our website using ‘cookies’.
Lawful basis for processing
We process personal data in accordance with the data protection principles of fairness, lawfulness and transparency and on the following bases:
a. Performance of contract;
b. Compliance with legal obligations;
c. Legitimate interests; and
d. Consent (where required).
How Quantas uses personal data
We may use your Personal Data for the following purposes:
a. Where we need to perform the Services to you or where we are about to enter a business relationship with you to provide the Service.
b. To manage and /or administer your relationship with our office, including account opening and client onboarding, processing payments, invoicing, or providing any ancillary services to you.
c. To confirm your identity where such action is relevant for compliance and regulatory purposes.
d. To manage our relationship with you including providing updates, reminders, requests and directions relevant to our business relationship with you or our legal obligations.
e. To protect the security of communication systems, websites and other systems, and to detect security threats, fraud or other criminal or malicious activities against our office or our customers.
f. Upon receipt of instruction or request from you or any third party authorized by you.
g. For the purposes of communication with you through approved channels of communications and where necessary to keep you up to date on the latest products, announcements, and other information.
h. To provide you with newsletters, surveys, emails, updates and other general communications and marketing in the context of the sale of the Services offered by us or similar goods and services offered by us.

How will we share your personal data
We may share Personal Date within our corporate group, including with our parent company, subsidiaries, affiliates, and related entities (collectively, the “Group”), for the purposes set out in this Privacy Notice.
Such sharing may occur where necessary for:
a. Client onboarding, know-your-customer (KYC), and customer due diligence (CDD);
b. Anti-money laundering and counter-terrorism financing (AML/CFT) compliance, including sanctions screening and transaction monitoring;
c. Provision of investment, brokerage, custody, and related financial services;
d. Risk management, internal audit, compliance oversight, and regulatory reporting;
e. IT systems administration, data hosting, and operational support;
f. Prevention, detection, and investigation of fraud or financial crime;
g. Group-wide business management, analytics, and strategic planning.
All Group entities are required to:
a. Process personal data in accordance with applicable data protection laws, including the Jamaican Data Protection Act;
b. Maintain appropriate technical and organisational safeguards to protect personal data;
c. Restrict access to personal data on a need-to-know basis;
d. Ensure confidentiality and security consistent with this Privacy Notice. Where personal data is transferred to a Group entity located outside Jamaica, we will ensure that:
a. The recipient jurisdiction provides an adequate level of data protection; or
b. Appropriate safeguards are implemented, including contractual protections and internal data sharing agreements, to ensure compliance with applicable legal requirements.
We rely on legal bases including the performance of contractual obligations, compliance with legal and regulatory requirements, and our legitimate interests in operating an efficient and compliant financial services group.
Otherwise, we will limit sharing of your Personal Data as follows:
a. We may share your Personal Data with any government agency in Jamaica (including financial institutions and regulatory bodies) for the purposes of fraud and crime prevention purposes.
b. We may share your Personal Data with any third-party to whom we assign or novate any of the rights or obligations of Quantas under any applicable agreement/arrangement.
c. We will otherwise only disclose your Personal Data when you direct us or give us permission to do so, when we are required by applicable law or regulations or judicial or official request to do so, or as required to investigate actual or suspected fraudulent or criminal activities.
d. We may also use aggregated Personal Data and statistics for the purpose of monitoring website usage to help us develop our website and our Services.
We may also share your Personal Data with a variety of the following categories of third parties as
necessary:
i. Our professional advisers such as lawyers and accountants.
ii. Professional indemnity or other relevant insurers.
iii. Regulators/tax authorities/corporate registries.
iv. Third parties to whom we outsource certain services including but limited to, document processing and translation services, confidential waste disposal, information technology systems or software providers, information technology support service providers, document and information storage providers.
v. Third-party postal or courier providers who assist us in delivering documents related to a matter.
Please note this list is non-exhaustive and there may be other examples where we need to share your Personal Data with other parties to provide the Services.
Can you refuse to share personal data with us?
Personal Data is received by us on a voluntary basis and upon request from us on the basis of us being in compliance with the laws of Jamaica. Where, however, you do not provide us with the Personal Data requested by our office, we may be delayed or unable to provide the Services to you.
Security
We take appropriate technical and organizational measures to keep your Personal Data confidential and secure and your Personal Data is stored both electronic and in paper format. All of our employees who have access to and are associated with the processing of your Personal Data, are obliged to respect the confidentiality of such Personal Data. We, however, do not make any representations or warranties that your Personal Data may not be accessed, disclosed, altered, or destroyed by breach of such safeguards. We will notify you immediately in the event of a security breach which includes your Personal Data.
Transfer of personal data
There may be circumstances in which your Personal Data would be transferred to a territory outside of Jamaica and such territory may not provide for an adequate level of data protection as granted in Jamaica. When making such transfers, we shall ensure that they are subject to appropriate safeguards in accordance with any applicable data protection legislation. Your consent must be given for such transfer of Personal Data, and you should not hold us liable for the manner in which your Personal Data is held or processed by any third parties which are situated outside Jamaica.
Retention of personal data
We will generally retain your Personal Data provided to us either physically or electronically during our business relationship for a period as may be reasonably necessary to fulfil the purposes it was collected for including legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe it is necessary including but not limited to the prospect of litigation in respect of our business relationship with you. Thereafter our files may be destroyed, and we are not obliged to provide you with any notice of such destruction.
What are your rights with respect to data protection?
You will have the following rights with respect to your Personal Data:
– Access
You are entitled to ask us if we are processing your Personal Data and, if we are, you can request access to your Personal Data. This enables you to receive a copy of the Personal Data we hold about you and certain other information regarding the Personal Data.
– Rectification
You are entitled to request that any incomplete or inaccurate Personal Data we hold about you is rectified. If you are entitled to rectification and if we have shared your Personal Data with others, we will notify them about the rectification where possible. If
you make such a request, where possible and lawful to do so, we will also tell you who we have shared your Personal Data with so that you may contact them directly.
– Erasure
You are entitled to ask us to delete or remove Personal Data in certain circumstances such as where we no longer need it or if you withdraw your consent (where applicable). There are also certain exceptions where we may refuse a request for erasure, for example,
where the Personal Data is required for compliance with local laws or in connection with claims. If you are entitled to erasure and if we have shared your Personal Data with others, we will notify them about the erasure where possible.
– Restriction
You are entitled to ask us to suspend the processing of your Personal Data, for example, if you would like for us to establish its accuracy or the reason for processing it.
– Transfer
You may request that we transfer certain of your Personal Data to another party.
– Objection
You are entitled to ask us to stop processing your Personal Data in certain circumstances, for example, where the processing is likely to cause substantial damage or distress except if we can demonstrate compelling legal grounds for the processing. You also have the
right to object where we are processing your Personal Data for direct marketing purposes. You may opt-out of receiving direct marketing from us at any time.
– Automated decisions
You may contest any automated decision made about yourself where this has a legal or similar significant effect and ask for it to be reconsidered.
– Consent
If we rely on your consent (or explicit consent) as our legal basis for processing your Personal Data, you may withdraw your consent at any time. However, we note that this will not affect the lawfulness of any processing carried out before you withdraw your consent.
